The advertisement under complaint is a 16 page A4 sized colour catalogue titled ‘Funkita Girls Beach House, Summer 2011’. The catalogue contains a range of colour images of girls in Funkita swimwear, some posed individually and other posed in groups. The images use a number of settings in and around a beach house, including a Kombi van. The inside cover (pg 2) of the catalogue contains text describing the feel and theme of the swimwear range. The latter half of the catalogue contains a number of product images of the swimwear along with descriptions of each style in the range and a size chart.

She is holding a bag of McDonalds in one hand and a new McDonald’s Choc Whirl frappe in the other. The woman presses the button for the elevator and takes a sip of her frappe. We hear the ding of the elevator, the door opens and then in slow-motion a wave of choc sauce comes flooding out of the elevator. We then see close ups of the frappe mixture being poured over ice and then blended.

The advertisement uses a large warehouse full of tyres to describe how confusing it is to choose tyres. The three Yokohama products presented use brightly coloured point of sale tyre centres to execute this strategy as it is explained by the voice over “If you want a long lasting everyday tyre, choose green. For extra safety, choose blue. And for high performance choose red.” The tyres roll out in front of the talent and he bends down to look at them. The call to action is to “Ask your tyre dealer about Yokohama, the easiest tyres to choose”.

One of the woman in the kitchen says that the woman outside has porked both the postman and the rest of the neighbourhood and her friend spits out her tea in shock. We then see a house-warming party the week before showing the woman from outside serving Pork Bolognese to her guests - one of whom is the postman. A male voice then states “An authentic Italian spag bol tastes better with pork mince. So if you really want to impress – get some pork on your fork”. The Australian Pork logo is then shown on a black background along with the end line written in white text “Get some Pork on your fork”.

A doctor appears on screen explaining “Sometimes you can hear lung cancer in smokers before you see it.” The next scene shows a tube (baronchoscope) inserted down the sedated patient’s throat as the doctor continues “That whistling noise, it’s the air racing around…the lung cancer almost completely blocking an airway”. An internal shot of the tumour being investigated is shown as the doctor concludes “By the time most lung cancers are discovered… it’s already too late to operate.” Words appear on the screen ‘Every cigarette brings cancer closer’.
